The Division of Criminal Justice takes no position on the concept of H.B. No. 5898, An Act Concerning Aid in Dying for Terminally Ill Patients, but must raise the same concerns that we brought to the Joint Committee on Judiciary when similar legislation was proposed in 2015 (H.B. No. 7015). We state again, as we did then, that the bill as now written could have unintended and very unwelcome consequences.

Linda Isner of Murdered by Hospice: Vote "No" on HR 1676, the Palliative Care and Hospice Training and Education Act

My husband Alan Isner was overdosed on Ativan Morphine and Haldol in a hospice and died when all he needed was anxiety medication. He was not suffering from pain or agitation but was given high doses of these drugs and the medical examiner's report revealed enough Morphine to kill several people.

Memo to the U.S. Senate HELP Committee: Vote No on the Palliative Care and Hospice Education and Training Act

I.  INTRODUCTION

I am an elder law attorney and president of Choice is an Illusion, a nonprofit corporation opposed to assisted suicide and euthanasia.[1] Formed in 2010, Choice is an Illusion fights against assisted suicide and euthanasia throughout the U.S. and in other countries.[2] We also fight against hospice and palliative care abuse.

S. 693, the Palliative Care and Hospice Education & Training Act," amends the existing Public Health Service Act to require financial support for “Palliative Care and Hospice Education Centers.”[3] This is a new program, which will include direct patient care.[4]

Existing federal palliative care programs, such as the Medicare hospice benefit, are plagued by fraud, poor quality care and a gross waste of taxpayer money.[5] S. 693 must be rejected unless problems with existing programs are resolved; Congress must not throw good money after bad. The bill must also be rejected for the reasons set forth below.

Sean Davison, a New Zealand citizen who was convicted of assisted suicide in Dunedin, appeared in a South African court on Wednesday on a murder charge.
The charge is in relation to the death of Anrich Burger, 53, who became a quadriplegic after a motor vehicle accident in 2005. He was not terminally ill.

California: Heirs Risk Forfeited Inheritance & Murder Charge If They Kill Victims Under Void Act

In California, a person commits murder in the first degree via "willful, deliberate, and premeditated killing."[1] California also has "slayer statutes," providing that murderers shall not inherit from their victims. As an example, California's Probate Code states:
(a) A person who feloniously and intentionally kills the decedent is not entitled to any of the following:
(1) Any property, interest, or benefit under a will of the decedent, or a trust created by or for the benefit of the decedent or in which the decedent has an interest ...  [2]

Utah: House Passes Bill Criminalizing Assisted Suicide

The Utah House passed a bill Tuesday that would criminalize helping someone commit suicide — despite some concern from lawmakers that the bill could unintentionally target physicians or family members of terminally ill patients.

Rep. Michael McKell, R-Spanish Fork, has sponsored House Bill 86, which would amend Utah’s manslaughter statute to include assisted suicide. This means a person would be guilty of a second-degree felony — which is punishable by up to 15 years in prison — if prosecutors can prove he or she provided “the physical means” for someone to commit suicide.

PROVO, Utah (KSTU) -- A judge will decide if a Spanish Fork man will face trial on a murder charge in the suicide of a 16-year-old girl.

Utah County prosecutors argue that Tyerell Przybycien's actions led Jchandra Brown to kill herself, and he should be tried for first-degree felony murder and a class B misdemeanor charge of failure to report a body. His defense lawyers argued that Brown was responsible for her own actions.

Massachusetts: Michelle Carter Convicted of Involuntary Manslaughter Due to Assisting Suicide

NPR  A Massachusetts judge has found Michelle Carter guilty of involuntary manslaughter after, prosecutors say, the then-teenager sent a fellow teenager text messages that urged him to commit suicide.

Juvenile Court Judge Lawrence Moniz decided the case, which Carter had opted to be heard by a judge rather than a jury. Even before Moniz read his verdict Friday, Carter, 20, was weeping and holding a tissue in the courtroom. The judge agreed with prosecutors that Carter's "wanton and reckless conduct" had resulted in the death of Conrad Roy III.

Deceptive names for legislation are nothing new, but this takes the cake.

Introduced by Democrat Amy Paulin in the Assembly and Republican John Bonacic in the state Senate, the bill would make it easier for terminal New York patients to get doctors to give them fatal doses of drugs.

They call it an “aid in dying” bill, but “Assisted Suicide Enhancement Act” is more to the point.
Or “The Streamlining Euthanasia Act.”

Nurse Admits Killing Patients to Ease Her Workload

A former nurse in the Czech Republic has admitted murdering six of her elderly patients with massive doses of potassium in order to ease her workload.

Vera Maresova, 50, confessed to killing five women and one man over a four-year period at a hospital in Rumburk - a small town in the north of the country.

Dubbed 'Nurse Death' by local media, Maresova was initially arrested over the death of a 70-year-old woman last August, but has now admitted killing five more people between 2010 and 2014 following a police investigation.

According to the prosecution, Maresova injected the potassium straight into the blood stream of her six elderly patients, which caused them to suffer heart failure and eventually death.

All of her victims were already in the intensive care unit at the hospital and it is believed Maresova thought their deaths would simply be attributed to natural causes.

Chicago lottery winner's death ruled a homicide

It seems ageism is getting younger. The victim in this case was 46 years old. Note that, except for a concerned relative's persistence, this murder would have gone undetected. Apparently it is not considered "suspicious" when you die suddenly at 46 - even when you have "suddenly" become wealthy...

CHICAGO (AP) — With no signs of trauma and nothing to raise suspicions, the sudden death of a Chicago man a day after he collected a large pile of lottery winnings was initially ruled a result of natural causes.

Nearly six months later, authorities have a mystery on their hands after medical examiners, responding to a relative's pleas, did an expanded screening and determined that Urooj Khan, 46, died shortly after ingesting a lethal dose of cyanide. The finding has triggered a homicide investigation, the Chicago Police Department said.

"It's pretty unusual," said Cook County Medical Examiner Stephen Cina, commenting on the rarity of cyanide poisonings. "I've had one, maybe two cases out of 4,500 autopsies I've done."

In June, Khan, who owned a number of dry cleaners, stopped in at a 7-Eleven near his home in the West Rogers Park neighborhood on the city's North Side and bought a ticket for an instant lottery game.

He scratched off the ticket, then jumped up and down and repeatedly shouted " I hit a million," Khan recalled days later during a ceremony in which Illinois Lottery officials presented him with an oversized check. He said he was so overjoyed he ran back into the store and tipped the clerk $100.  "Winning the lottery means everything to me," he said at the June 26 ceremony, also attended by his wife, Shabana Ansari; their daughter, Jasmeen Khan; and several friends. He said he would put some of his winnings into his businesses and donate some to a children's hospital.

Khan opted to take his winnings in a lump sum of just over $600,000. After taxes, the check, issued July 19 from the state Comptroller's Office, was about $425,000, said lottery spokesman Mike Lang.

Khan died a day later.

No signs of trauma were found during an external exam and no autopsy was done because, at the time, the Cook County Medical Examiner's Office didn't automatically perform them on those 45 and older unless the death was suspicious, Cina said. The cut-off has since been raised to age 50.

A basic toxicology screening for opiates, cocaine and carbon monoxide came back negative, and the death was ruled a result of the narrowing and hardening of coronary arteries.

But a relative came forward and asked authorities to look into the case further, Cina said. He refused to identify the relative.

"She (the morgue worker) then reopened the case and did more expansive toxicology, including all the major drugs of use, all the common prescription drugs and also included I believe strychnine and cyanide in there just in case something came up," Cina said. "And in fact cyanide came up in this case."
Chicago Police Department spokeswoman Melissa Stratton confirmed the department was now investigating the death and said detectives were working closely with the Medical Examiner's Office.

Man convicted of murder "claimed his mother committed suicide"

A 27-YEAR-old Perth man has been found guilty of murdering his mother to steal her money and property.

Brent Donald Mack, 27, was on trial in the WA Supreme Court accused of murdering his mother, Ah Bee, between December 18 and 29 in 2008.

Ms Mack, 56, who also went by the name of Pauline, was last seen alive in September 2008, but her body has never been found.

In a police interview earlier this year, Mack claimed his mother committed suicide and had asked him not to tell anyone.

Justice John McKechnie, who presided the case without a jury, returned the guilty verdict today.

A psychiatric report and psychological report were ordered.

Mack will be sentenced on January 25.
