The proposed bill, "An Act Concerning Aid in Dying for the Terminally Ill," seeks to legalize “aid in dying,” which is a euphemism for active euthanasia and physician-assisted suicide.[1]

Margaret Dore: Euthanasia Act "Must Be Set Aside"

On March 24, 2020, a hearing was held in Glassman v Grewal, a lawsuit, which seeks to invalidate New Jersey's euthanasia law, formally known as the "Medical Aid in Dying for the Terminally Ill Act."

The specific matter before the court was a motion to dismiss brought by the defendant, New Jersey Attorney General, Gurbir S. Grewal.

The plaintiff, Joseph Glassman, represented by E. David Smith, opposed the motion, as did Margaret Dore, president of Choice is an Illusion, representing herself as amicus curiae.

Dore, who had filed both an amicus brief and a reply brief, argued that the Act must be set aside pursuant to the New Jersey Constitution. Her arguments largely tracked her reply brief, a portion of which is set forth below.

I.  INTRODUCTION

I am president of Choice is an Illusion, a nonprofit corporation opposed to assisted suicide and euthanasia.[1] I am also an attorney in Washington State USA where these practices are legal.[2] Our law is based on a similar law in Oregon.[3]

My background includes providing legal analysis and/or testimony against assisted suicide and euthanasia, in 22 US states, South Africa and Australia. I have participated in public debates as well as public interest litigation.

The “End of Life Choice Bill” seeks to legalize assisted dying, which means assisted suicide and euthanasia.[4] If enacted, the bill will apply to people with years or decades to live, and provide cover for murder. I urge you to recommend to Parliament to reject this bill.

Dear Legislators:

I directed the Program in Human Rights and Health at the University of Minnesota School of Public Health from 2006-2016 and am a past chair of the American Public Health Association's Ethics Special Primary Interest Group (now Ethics Section).

While working on my dissertation I was a visiting preceptor (research rotation) at the Hennepin County (Minnesota) Medical Examiner's Office. It was greatly impressed upon me the need for scientific accuracy in the medico-legal documentations of death.
