A Montreal couple is calling for disciplinary measures against a psychologist they say counselled one of them to kill the terminally ill other.

When Miranda Edwards was diagnosed with an aggressive form of cancer she said she was determined to fight it.

“I want to live, I want every medical intervention possible,” she said. “I will fight to the end. I will do every treatment, everything possible to stay alive.”

Washington State’s Death with Dignity Act was passed by the voters as Initiative1000. During the election, backers touted it as providing "choice" for individuals. A glossy brochure declared, "Only the patient — and no one else — may administer the [lethal dose]." The Act does not say this anywhere.[1]

•  The Act legalized assisted suicide as that term is traditionally defined. In the fine print, the Act allows euthanasia.

"Do or Refer" Doctors Are Not Allowed to Use Their Best Judgment for Individual Patients (No More Jeanette Halls)

Yesterday, a doctor asked me about "do or refer" provisions in some of the newer bills seeking to legalize assisted suicide in the United States. For this reason, I now address the subject in the context of a 2018 Wisconsin bill, which did not pass.

The bill, AB 216, required the patient's attending physician to "fulfill the request for medication or refer," i.e. to write a lethal prescription for the purpose of killing the patient, or to make an effective referral to another physician, who would do it.

The bill also said that the attending physician's failure to comply would be "unprofessional conduct" such that the physician would be subject to discipline. The bill states:

Nevada: Bill All But Dead

SB 165, which would have legalized assisted suicide and euthanasia in Nevada, failed to make it out of its house of origin, so that it is now all but dead. According to 3 News Las Vegas:

While the bills the couldn't make it out of committee are technically off the table, they won't officially be out of the question until the Legislative Session ends in June.

The next major deadline comes on May 17.

I.  INTRODUCTION

I am an attorney in Washington State where assisted suicide is legal.[1] Our law is based on a similar law in Oregon. In the fine print, both laws allow euthanasia. Both laws are similar to the proposed bill, LD 1313.[2]

The proposed bill seeks to legalize physician-assisted suicide and euthanasia as those terms are traditionally defined. If enacted, the bill will apply to people with years or decades to live. Individuals with money, meaning the middle class and above, will be especially at risk. I urge you to reject LD 1313.

Nevada: Patient Protections Are Mere Window Dressing to Lull the Public Into Accepting Assisted Suicide and Euthanasia

Nevada's pending euthanasia bill, S.B. 165, sets forth patient protections in sections 3 through 29, described as “safeguards, procedures, written requirements and reporting functions.”[1] The bill also repeatedly says that actions are to be done in “accordance” with the provisions of sections 3 through 29.[2] For example, the bill states:

Death resulting from a patient self-administering a controlled substance that is designed to end his or her life in accordance with the provisions of sections 3 to 29, inclusive, of this act does not constitute suicide or homicide. (Emphasis added).[3]

Federal Palliative Care Euthanasia Bill Moving

On January 17, 2019, the "Palliative Care and Hospice Education and Training Act" was introduced in the 116th Congress as H.R. 647 and referred to the House Committee on Energy and Commerce. No text was provided.

The Congressional website has since been updated with the posting of a complete bill, which is identical, or nearly identical, to last session's H.R. 1676, as amended. (The companion bill was S. 693).

The Massachusetts High Court upheld the voluntary manslaughter conviction of Michelle Carter for assisting the suicide of Conrad Roy who was 18 at the time of his death. Carter, who was 17 at the time of the death, was sentenced to 15 months in prison.

A Democratic-sponsored, end of life bill is, for now, dead in the Utah Legislature.

The House Rules Committee, voting along partisan lines, refused Thursday to allow HB121 to be heard by a standing committee – thus killing the bill unless at a later date Rules members change their minds....

Unless House Democrats can get enough floor votes to lift HB121 from Rules (not likely), or unless Republicans on Rules change their minds (that could happen), end of life legislation is dead in the 2019 Legislature, before the first week is even over.

1.  The Act

3.  Assisting Persons Can Have an Agenda

Persons assisting a suicide or euthanasia can have an agenda. Consider Tammy Sawyer, trustee for Thomas Middleton in Oregon, which has a similar law. Two days after his death by legal assisted suicide, she sold his home and deposited the proceeds into bank accounts for her own benefit.[2] Consider also Graham Morant, recently convicted of counseling his wife to kill herself in Australia, to get the life insurance. The Court found:

[Y]ou counseled and aided your wife to kill herself because you wanted ... the 1.4 million.[3]

Federal Closet Euthanasia Act May Be Moving

Five days ago, an op-ed appeared in the New York Post advocating for Congressional passage of the "Palliative Care and Hospice Education and Training Act."[1] The Act has not been introduced in the current (116th) Congress.[2] There are, however, rumors that it will be or that passage will occur by packaging it with other legislation. With the appearance of the op-ed, the veracity of these rumors is well founded.

The Act was introduced in the last (115th) Congress as H.R. 1676 and S. 693. Its stated purpose was to provide financial support for palliative care and hospice education centers, including direct patient care. The Act easily passed the House on a voice vote.[3]

There was and is, however, a catch.

US Euthanasia Bill All But Dead - For Now

This year, the US Congress considered the "Palliative Care and Hospice Education and Training Act," bills H.R. 1676 and S. 693. The Act seeks to provide financial support for palliative care and hospice education centers, including direct patient care.

The Act was viewed as noncontroversial. Indeed, H.R. 1676 passed the House on a voice vote without opposition.

There is, however, a catch.

This is because US euthanasia advocates are currently promoting "medical aid in dying" (euthanasia) as "palliative care."[1] There is a similar situation in Canada, where "lobbies are trying to influence the government to include so-called Medical Aid in Dying ... in palliative care."[2]

The significance is this: If the Act is passed into law and the above advocacy efforts are successful, medical aid in dying (euthanasia) will become part of palliative care and therefore part of the Act. More to the point, the Act will legalize and also finance euthanasia in government funded centers throughout the US. The Act is a closet or "springing" euthanasia bill.

In 2012, an article in the New England Journal of Medicine reported that many doctors object to physician-assisted suicide.[1] The article's authors, Dr. Lisa Lehmann and Julian Prokopetz, argued back that assisted deaths need not be physician-assisted.[2] They said that a central government mechanism should provide the assistance instead:

Graham Robert Morant was last month found guilty on two charges — counselling suicide and aiding suicide — for persuading his wife Jennifer Morant, 56, to kill herself in her car in 2014 and helping her buy the necessary equipment from a hardware store.

I live in Oregon where assisted suicide is legal. Our law passed in 1997 by a ballot measure that I voted for.

In 2000, I was diagnosed with cancer and told that I had 6 months to a year to live.  I knew that our law had passed, but I didn’t know exactly how to go about doing it. I tried to ask my doctor, Kenneth Stevens MD, but he didn’t really answer me. In hindsight, he was stalling me.

S. 693, the Palliative Care and Hospice Education & Training Act," amends the existing Public Health Service Act to require financial support for “Palliative Care and Hospice Education Centers.”[3] This is a new program, which will include direct patient care.[4]

Existing federal palliative care programs, such as the Medicare hospice benefit, are plagued by fraud, poor quality care and a gross waste of taxpayer money.[5] S. 693 must be rejected unless problems with existing programs are resolved; Congress must not throw good money after bad. The bill must also be rejected for the reasons set forth below. 

Australian Man Convicted of Assisting Suicide

An Australian man has been convicted of aiding his wife's suicide, after a court heard he had coveted payouts from her life insurance.

Jennifer Morant, 56, had suffered from chronic pain but was not terminally ill when she died in 2014, a court heard.

A jury found that Graham Morant, 69, counselled and aided his wife to take her life. He had denied both charges.

Like many Americans, I have a story about hospice care for a loved one. When my father was dying from complications of dementia and diabetes, hospice caregivers sat with him, provided pain relief, and helped him be comfortable. They also gave my mother peace of mind that her beloved husband was receiving kind attention in his final weeks. To this day, she refers to those hospice workers as angels.

Sadly, not every family’s story is a positive one.

The Supreme Court has endorsed the right of Mexico City residents to use marijuana for medicinal purposes as established by the city’s constitution.

Eight of 11 judges ruled yesterday that the Constitutional Assembly of Mexico City, a body formed to create a new constitution for the capital, had not encroached on federal jurisdiction by including an article enshrining the right to use medicinal marijuana....

The Supreme Court also endorsed a range of other articles in the city’s constitution against which challenges had been filed, including the right to die with dignity, the right of access to water, the right to sexuality, the right for the local government to enter into agreements with international entities and the right for migrants not to be criminalized while in the capital regardless of their legal status.

With regard to the dignified death provision, the PGR argued that it effectively allowed for euthanasia and assisted suicide, which are prohibited under federal law and whose regulation is the exclusive domain of the federal government.

Northwest Montana Fair: Thank You to Our Volunteers!

Thank you to our volunteers who braved the smoke to join us at the 2018 Northwest Montana Fair in Kalispell.

We educated the public about problems with legalization, including how people with years to live are encouraged to throw away their lives, and fatal elder abuse.

We also heard from people who were considering assisted suicide for themselves. Two were older men who came to the booth about fifteen minutes apart. I am an attorney and president of Choice is an Illusion, a 501(c)(4) non-profit. Formed in 2010, Choice is an Illusion fights against assisted suicide and euthanasia throughout the United States and in other countries.

David Grube’s Aug. 5 guest commentary in The Star said Oregon’s suicide rates “overall have gone down ... since its Death with Dignity Act [legalizing assisted suicide] went into effect in 1997.” I disagree with this claim.

According to the Centers for Disease Control and Prevention’s “Vital Signs” website, Oregon’s suicide rate went up 28.2 percent from 1999 to 2016.

Australia Defeats Euthanasia

In a narrow vote the Australian Senate today (Thursday) defeated by 36-34 a move to permit the Australian Capital Territory and the Northern Territory to enact laws on euthanasia and assisted suicide. Most of the Australian media was campaigning for the pro-euthanasia move. A lot of work went on in the background with the group established by Paul Russell (Hope) encouraging a joint-Party meeting for Senators and staff to hear from two experienced Doctors from Victoria.

Hey Kansas City Star: Oregon’s Suicide Rate Went Up 28.2%, Not Down! Correct This Error.

On August 4, 2018, the Kansas City Star published this false statement:

"National and state level data from the Centers for Disease Control and Prevention’s National Vital Statistics System suggest that suicide rates have varied slightly, but overall have gone down in Oregon since its Death with Dignity Act went into effect in 1997."

Bristol County Prosecutors have filed their response to the appeal of Michelle Carter, arguing that the Plainville woman was rightfully convicted of involuntary manslaughter for pressuring her boyfriend Conrad Roy III into killing himself.

Roy died in 2014 after he turned on a gas-powered water pump in his truck and allowed the cabin to fill with carbon monoxide, following a lengthy battle with depression.

But police found text messages on Carter's phone that led them to believe it was no simple suicide.
